Welcome to GPT Realtime at gpt-realtime.ai. These Terms of Service (the "Terms") govern your access to and use of our website, applications, downloads, documentation, and AI voice generation, realtime session, and API workflow services (collectively, the "Service"). The Service

GPT Realtime provides browser-based access to voice agent workflows, including live speech prompts, realtime session testing, image-aware context, API planning, function-calling tests, cached context, previews, downloadable outputs, and credit-based usage. Features, model availability, usage limits, and pricing may change over time.

GPT Realtime is an independent service and does not claim to be the official publisher, owner, or developer of any underlying third-party model unless explicitly stated.

Accounts and Access

3. Unauthorized Use: You must notify us promptly if you become aware of unauthorized access or suspected misuse of your account.

Acceptable Use

You agree not to:

• Upload or process content you do not have the right to use, including protected audio, images, scripts, logos, designs, portraits, trademarks, or other third-party materials.

• Interfere with service stability, security protections, rate limits, billing systems, or access controls.
• Use automated methods in a way that degrades performance or violates plan or usage limits.
• Misrepresent outputs, voice demos, transcripts, or API plans as official materials from another company, model owner, brand, or public figure when such representation would be false or misleading.

Your Content and Outputs

You retain ownership of the prompts, scripts, optional image context, workflow notes, and other materials you submit, as well as the outputs you generate, subject to applicable law and these Terms.

You are solely responsible for:

• The legality and rights status of any prompts, uploads, references, session inputs, and outputs.
• Reviewing outputs before publishing, selling, or using them in commercial or regulated contexts.
• Ensuring that your use of outputs complies with intellectual property, privacy, advertising, and platform rules.

You do not obtain ownership of the underlying models, infrastructure, software, or service materials used to operate GPT Realtime.

Intellectual Property

All content, code, workflows, documentation, design elements, and interface materials provided by GPT Realtime are protected by intellectual property laws. GPT Realtime and its licensors retain all rights not expressly granted in these Terms.

Privacy

Pricing, Credits, and Payments

Suspension and Termination

To the fullest extent permitted by law, GPT Realtime and gpt-realtime.ai will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profits, revenues, data, goodwill, or business opportunities.

Our total liability for any claim relating to the Service will not exceed the amount you paid to us for the Service during the 3 months preceding the event giving rise to the claim.

Indemnification

You agree to indemnify and hold harmless GPT Realtime, gpt-realtime.ai, and their affiliates, officers, directors, employees, and agents from claims, damages, losses, liabilities, costs, and expenses, including reasonable legal fees, arising from:

• Your use of the Service
• Your prompts, uploads, references, session inputs, or outputs
• Your violation of these Terms or applicable law
• Your infringement of third-party rights

Governing Law and Disputes

These Terms are governed by the laws of the jurisdiction in which GPT Realtime is established, without regard to conflict of law principles. Disputes arising out of or relating to these Terms or the Service will be resolved in the competent courts or through arbitration in that venue, as permitted by applicable law.
